ADMINISTRATIVE ORDER

AND NOW, this day of September, 2004, it is hereby ordered that Administrative Order #2003-6 is amended in the following respect: When an application for A.R.D.has been filed, the defense counsel is not required to attend the arraignment/pre-trial conference. However, the defendant must attend. In all other respects, Administrative Order #2003-6 shall remain in effect.

Comment: Defense Counsel’s attendance at the pre-trial conference is not required if an A.R.D. application has been completed and filed. An intention to file for A.R.D. or an agreement to file for A.R.D. is not sufficient to excuse counsel’s attendance.
