MAGISTERIAL DISTRICT JUDGE TECHNICIAN/SECURE STAFF AREA ACCESS No.: C-48-AD-29-2021
ADMINISTRATIVE ORDER
AND NOW, this 18th day of March, 2021, pursuant to (1) 42 Pa.C.S. § 325(e), establishing the powers of the President Judge; (2) Pennsylvania Rule of Judicial Administration 605(A), stating that the President Judge shall supervise magisterial district courts within the judicial district; (3) Pennsylvania Rule of Criminal Procedure Rule 116, stating that the President Judge shall be responsible for ensuring that the judicial district is in compliance with all rules and statutes; and (4) Pennsylvania Rules of Conduct, Office Standards and Civil Procedure for Magisterial District Judges Rule 1.2, establishing that a Magisterial District Judge shall act in a manner that promotes public confidence, it is hereby ORDERED as follows:
In order to promote public confidence in the independence, integrity, and impartiality of the judiciary, and to avoid impropriety and the appearance of impropriety under Pennsylvania Rules of Conduct, Office Standards and Civil Procedure for Magisterial District Judges Rule 1.2 Promoting Confidence in the Judiciary, in addition to preventing fiscal impropriety, Magisterial District Judges in Northampton County shall prohibit police officers, constables, and members of the public from entering the Magisterial District Judge technician/secure staff area of a Magisterial District Court, except that the following individuals may enter the Magisterial District Judge technician/secure staff area of a Magisterial District Court: (1) a police officer in performance of his/her lawful duities; (2) authorized employees of the Court and County of Northampton in performance of their lawful duties; and (3) authorized agents of the Court
or the landlord of the Magisterial District Court when performing necessary repairs, maintenance, or cleaning.
This Order is effective beginning Mach 18, 2021.
