ORDER OF COURT
AND NOW, 30TH day of December, 2010, the following procedure is adopted effective, January 1, 2011, with respect to the case management of credit card debt collection cases.
1. In those cases in which service has been effected, but no timely
answer has been filed by Defendant, the Plaintiff shall file for judgment within 90 days.
2. In those cases where service has been effectuated and a timely
answer has been filed, the parties are directed to complete discovery within ninety days. Ninety days thereafter, the Plaintiff’s attorney shall list those cases for arbitration. The Prothonotary shall clearly mark the praecipe for arbitration as a credit card debt collection case. The Court Administrator shall maintain a separate docket for the credit card debt collection cases.
3. The Prothonotary is directed to discontinue all credit card
debt collection cases after one hundred eighty (180) days of continued inactivity.
4. After the entry of discontinuance, a case may be reinstated. To
reinstate a case, a party shall present a Motion to Reinstate to the Motions Court Judge. Said Motion shall contain compelling reason for reinstatement of the case.
