RULE N10.2.4. GRANT OF JURY TRIAL.
(a) Determination by Judge. The Hearing Judge will determine preliminarily whether a jury trial shall be granted upon any issue of fact arising upon a certification or appeal.
(b) Decree. If a jury trial is granted, the decree shall specify the issues to be tried, which may be in the form agreed upon by the parties, or as the Hearing Judge shall determine.
(c) Agreement of Parties. The Hearing Judge, with the consent of the parties, may frame the issues and order a jury trial to determine them without holding a preliminary hearing. In such case all of the rights of the proponent shall be preserved in the event that contestant fails to establish a substantial issue upon a material fact.
