N225 Content of Opening and Summing Up

RULE N225. CONTENT OF OPENING AND SUMMING UP.

(a) Opening. The plaintiff's attorney shall open the case by a brief and concise statement of what the plaintiff proposes to prove, to be followed immediately by a similar statement by the defendant's attorney, unless permission to reserve opening state ment is granted by the Court.

(b) Summation. After all the evidence is taken, the plaintiff's attorney shall have the opening argument, in which he shall fully state his contentions, to be followed immediately by the argument of the defendant's attorney, to which argument plaintiff's attorney is entitled to a brief reply which shall be confined strictly to a reply to the defendant's argument. In actions where the defendant has the affirmative of the disputed issue, the order of procedure shall be reversed.
