The staff of the Sheriff-Civil section processes civil action paperwork issued by the Prothonotary or another out-of-County court. They are responsible for preparing paperwork for service by the Sheriff’s Department as well as processing the Returns from said service. This is also the section which schedules and coordinates Sheriff’s Sales of both real estate and personal property.

    a) Types of papers handled include

    COMPLAINTS IN:
    Custody, Declaratory Judgment, Divorce, Ejectment, Equity, Mandamus, Mortgage Foreclosure, Quiet Title

    WRITS OF:
    Habeas Corpus, Replevin, Revival, Seizure, Summons (in equity) , Scire Facias

    PROTECTION FROM ABUSE (PFA)

    MISCELLANEOUS:
    Citation, Preliminary Order and Petition; Involuntary Termination of Parental Rights; Foreign County Execution Papers; Preliminary Injunction; Confession of Judgment Notice; Judicial Sales; Mechanics Lien 

    b) All submissions for service must be accompanied by a signed Northampton County Order For Service Request if filed in Northampton County or out of State. Service requests from another Pennsylvania County must be submitted with that County's duly executed deputization form. If using a Northampton County Order For Service Request, be certain to include a valid e-mail address as all affidavits of service will be returned via e-mail.      Execution for Personal Property and Attachment


    The following forms, documents and fees are required in order to file and process an Execution for Personal Property:

    one (1) Praecipe for Writ of Execution and two (2) copies
    one (1) original Writ of Execution
    one (1) signed Northampton County Order for Service Request for the levy, one (1) for each defendant to be served, and one (1) for each garnishee to be served - be certain to include a valid e-mail address as all affidavits of service will be returned via e-mail - the Order for Service Request can be obtained by clicking  here
    one (1) postage-paid envelope addressed to the attorney/plaintiff
    $28.75 filing fee for the Prothonotary's Office (no personal checks)
    $250.00 advance deposit fee for the Sheriff's Office (no personal checks)
     

    The above applies to Execution for Attachment with the following exceptions/additions:

    $29.25 filing fee for the Prothonotary’s Office (no personal checks)

    if Interrogatories are to be served, include one (1) original and one (1) copy for each garnishee; also, a fee of $60.00 per garnishee must be paid to the Prothonotary’s Office (no personal checks)

    certification of address for each defendant

     

    If property levied or attached by the Sheriff is owned or co-owned by someone other than the execution defendant, the third party can file a Property Claim with the Sheriff. The fee of $30.00 must accompany the Claim.

    One Sheriff’s Sale of Personal Property is held every month in the Sheriff’s Office on the basement floor of the Government Center. Sales are typically scheduled for the 3rd Friday of each month and begin at 10:00 a.m. Listings of property for sale are displayed in both the Prothonotary’s and Sheriff’s Offices. Items on the lists are not sold individually but rather as one lot.

     Execution for Real Estate


    The following forms, documents and fees are required in order to file and process an Execution for Real Estate:

    one (1) Praecipe for Writ of Execution and two (2) copies
    one (1) original Writ of Execution
    one (1) signed Northampton County Order for Service Request for the levy, one (1) for each defendant to be served, and one (1) for posting the handbill - be certain to include a valid e-mail address as all affidavits of service will be returned via e-mail - the Order for Service Request can be obtained by clicking  here
    one (1) original Notice of Sheriff’s Sale and two (2) copies for each defendant
    five (5) legible copies of the legal description of the real estate, including the parcel number and the current recital
    one (1) Affidavit Pursuant to Rule 3129.1 and one (1) copy
    one (1) Affidavit of Act 91 of 1983 - if Act 91 is not applicable, provide an affidavit that specifies the rule does not apply
    if execution is based on a money judgment (rather than mortgage foreclosure), include Writ of Execution Notice, list of Major Exemptions, and Claim for Exemption form (see PA R.C.P. 3252) – one original of each and two (2) copies for each defendant
    one (1) postage-paid envelope addressed to the attorney/plaintiff
    $28.75 filing fee for the Prothonotary’s Office (no personal checks)
    $2,500.00 advance deposit for the Sheriff’s Office (no personal checks)
